Terms and Conditions

Please read these Terms and Conditions carefully before using the Capalation mobile application and website (the "Service") operated by Capalation ("we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not use the Service.

Acceptance of Terms

By creating an account or using the Service in any way, you confirm that you are at least 13 years of age and that you have read, understood, and agree to be bound by these Terms and Conditions and our Privacy Policy. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

Description of the Service

Capalation is a mobile application and web platform that allows users to create and participate in photo-based challenges organized around themed prompts. Core features of the Service include:

User Accounts

To access most features of the Service, you must create an account. You agree to:

We reserve the right to suspend or terminate accounts that violate these Terms or that we determine, in our sole discretion, are harmful to the Service or other users.

User Content

The Service allows you to submit, upload, and share photos, theme descriptions, collection names, and other content (collectively, "User Content"). You retain ownership of any intellectual property rights in your User Content.

By uploading User Content to the Service, you grant Capalation a non-exclusive, worldwide, royalty-free, sublicensable license to use, store, display, reproduce, and distribute that content solely for the purposes of operating, improving, and promoting the Service.

You represent and warrant that: (a) you own or have the necessary rights to your User Content; (b) your User Content does not infringe the intellectual property, privacy, or other rights of any third party; and (c) your User Content complies with these Terms.

Your Use of Content

The Service and its original content (excluding User Content) are and will remain the exclusive property of Capalation. You may not copy, modify, distribute, sell, or create derivative works based on the Service or its content without our express written permission.

You may view and interact with other users' photos and themes strictly within the Service as intended. You may not download, reproduce, or use other users' photos outside the Service without their explicit consent.

Your Content and Conduct

You are solely responsible for your User Content and your conduct on the Service. You agree not to submit, upload, or share content that:

We reserve the right to remove any User Content that violates these Terms and to report illegal content to the appropriate authorities.

Account Termination Policy

You may delete your account at any time from the Settings screen within the app. Deleting your account will remove your profile and associated data in accordance with our data retention practices.

We may suspend or permanently terminate your access to the Service, without notice or liability, if you breach these Terms or if we determine that your continued use is harmful to the Service, other users, or third parties. Upon termination, your right to use the Service ceases immediately.

Collections and Voting

Collections are created and managed by users ("collection owners"). Collection owners may set visibility to open, private, or closed, and may set limits on contributors per theme. Capalation is not responsible for decisions made by collection owners, including acceptance or rejection of join requests.

Voting is available only to contributors who submitted a photo to a given theme. Each contributor may rank exactly three photos per theme. Voting results are computed based on points: 3 points for 1st place, 2 for 2nd, and 1 for 3rd. Voting outcomes are final once the results phase begins.

Digital Millennium Copyright Act (DMCA)

We respect intellectual property rights and respond to clear notices of alleged copyright infringement under the DMCA. If you believe your copyrighted work has been posted on the Service without authorization, please contact us with the following information:

  1. A description of the copyrighted work you claim has been infringed.
  2. The URL or location on the Service where the infringing material can be found.
  3. Your contact information, including name, address, telephone number, and email address.
  4. A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law.
  5. A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on its behalf.

Warranty Disclaimer

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, CAPALATION AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR UNAUTHORIZED ACCESS TO YOUR ACCOUNT.

In no event shall our total liability to you exceed the amount you paid us (if any) in the twelve months preceding the claim.

Indemnity

You agree to indemnify, defend, and hold harmless Capalation and its affiliates, officers, agents, and employees from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any third-party rights.

Ability to Accept Terms of Service

By using the Service, you affirm that you are at least 13 years of age. If you are between 13 and 18 years of age, you may only use the Service under the supervision of a parent or legal guardian who agrees to be bound by these Terms. We do not knowingly collect personal information from children under 13. If we learn we have inadvertently done so, we will promptly delete that information.

Third-Party Links and Services

The Service may integrate with or link to third-party services, including Google (for sign-in) and Supabase (for authentication and storage). We are not responsible for the privacy practices or content of any third-party services. Your use of third-party services is governed by their respective terms and privacy policies.

Assignment

You may not assign or transfer any rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.

Changes to These Terms

We reserve the right to update or modify these Terms at any time. When we make material changes, we will update the "Last updated" date at the top of this document. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in British Columbia, Canada.

General

These Terms constitute the entire agreement between you and Capalation regarding your use of the Service. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
